Wij bieden u de mogelijkheid om zelf de onterecht door u betaalde servicekosten bij Airbnb terug te vorderen. Hiervoor kunt u de voorbeeldbrief onder het formulier gebruiken. Wij horen nu echter van meerdere kanten dat Airbnb niet ingaat op individuele verzoeken.

U kunt er daarom ook voor kiezen u aan te sluiten bij Dienen van Twee Heren. Omdat er inmiddels al meer dan 50.000 facturen zijn geupload, kunnen wij de druk op Airbnb opvoeren door veel procedures te starten. Dit verhoogt de kans op uitbetaling aanzienlijk. Hoe meer mensen zich aansluiten, hoe sterker we staan. Alles dat u hoeft te doen is het formulier invullen en afwachten!

RE: Demand letter for reclaiming service fee based on Dutch law

Dear Sir/Madam, 

<<Naam>> hereby informs you as follows. 

Facts 

Tenant (huurder) as a consumer domiciled in the Netherlands used the Airbnb platform to conclude Tenancy Agreements with different landlords (verhuurders) (the Tenancy Agreements). These Tenancy Agreements are the result of services provided by Airbnb based on its agreements with both the landlords and Tenant. Based on these agreements, Airbnb amongst other things: i) presented the real estate of the landlords to Tenant; ii) forced parties to communicate and reach an agreement using the Airbnb platform; iii) facilitated and enabled the conclusion of the Tenancy Agreements between Tenant and the landlords; iv) facilitated payment by Tenant to the landlords and iv) charged both the landlords and Tenant a fee for the successful conclusion of the Tenancy Agreements. Therefore, Airbnb acted as an intermediary (bemiddelaar) (or even an agent (lasthebber)) for both the landlords and Tenant. 

Service fee 

As Airbnb must be well aware, under mandatory Dutch law an intermediary or agent is not entitled to charge any fee to the tenant if it also acts for the landlord and one of the parties is a consumer (articles 7:417 section 4 and 7:427 of the Dutch Civil Code). In violation of this mandatory stipulation, Airbnb charged Tenant, being a consumer domiciled in the Netherlands, the following service fee for its intermediary services in relation to the rent of real estate or a part thereof (see invoices attached):

Unduly payment by Tenant 

As there is no legal ground for charging this service fee, the total amount as stipulated above is unduly paid (onverschuldigd betaald) by Tenant to Airbnb. Moreover, charging this fee constitutes an unfair business-to-consumer commercial practice under Directive 2005/29/EC as implemented in article 6:193 et seq of the Dutch Civil Code. Only to the extent legally required for the service fees to be unduly paid, the stipulations on which the service fee was charged to Tenant are hereby annulled (vernietigd) pursuant to article 3:40 section 2 of the Dutch Civil Code. 

Demand 

Based on the above <<Naam>> summons Airbnb to refund the unduly paid amount within 14 days of the date of this letter by payment of Euro €<<Verschuldigd bedrag (tel alle door u betaalde servicekosten op)>> to <<Naam>>, <<IBAN>> with <<BANK>>, <<BIC>> with reference <<Refference ID>> This letter serves as a formal notice of default. 

If Airbnb fails to pay said amount (in time), <<Naam>>, hereby holds Airbnb liable for any and all damages Tenant will suffer. In addition, the amount due shall then be increased with statutory interest and (extra-judicial) collection costs, being 15% of the amount due with a minimum of EUR 40, increased with VAT. 

Ignoring this letter may lead to Tenant starting proceedings against Airbnb. In this respect, Tenant reserves all its rights and defenses.
